NTREIS Waiver Form

This AGREEMENT is made and entered into by the undersigned party (“Individual”) in conjunction with Participant’s request for exemption from NTREIS MLS subscription and/or fees.

  1. The Individual named below shall be exempt from NTREIS MLS subscription fees if such Individual meets any one or more of the requirements set forth in Paragraph 5.

  2. Such exemption is effective for the remainder of the calendar year in which the Waiver form is filed with Individual’s MLS Provider Association, unless terminated sooner. The exemption for any Individual shall automatically be revoked upon that Individual’s utilization of the NTREIS MLS in any manner (except as specified in paragraph 5 below).

  3. For the purposes of this agreement, utilization of the NTREIS MLS is further defined, but not limited to, the following actions: Use of any NTREIS MLS system (on-line or off-line) and/or Offering NTREIS benefits to real property owners.

I hereby certify that the above name Individual does not utilize the NTREIS MLS and is eligible for a waiver for one or more of the following reasons (Please check the box that applies):

Commercial salespersons who do not list, show, sell or lease residential property required to be filed with the MLS.
Appraisers, engaged exclusively in commercial appraisals, who do not utilize the MLS.
Other than a Participant, corporate officers who do not show, list, sell, lease, or appraise real property.
Licensed staff affiliated with property management companies who do not show, list, sell, lease or appraise real property and who do not ever utilize the MLS or the Listing Content.

I hereby certify that the above named Individual is eligible for a waiver of subscription fees for one or more of the following reasons (please check the box that applies):

Unlicensed Clerical Office Staff* of a Participant. Licensed staff or licensed Personal Assistants of Participants/Subscribers do not qualify under this exemption.
Unlicensed Personal Assistants of Participants/Subscribers – must provide NTREIS the name and license number of the Participant/Subscriber they assist below: (Access code = 95)

Be aware that any individual assigned a “05” administrative access code will have access to your entire inventory and full administration access to all information for the branch office where they are registered.

If the Individual utilizes the NTREIS MLS at any time, the NTREIS MLS Participant set forth in Paragraph 4 is obligated to pay an additional individual subscription fee for the current quarter and any other calendar quarter in which the Individual accessed the MLS. The NTREIS Participant is further subject to a fine of $50 per day (following a 30-day grace period) for each Individual using the NTREIS MLS, plus any additional fines, dues and payments that may be established by the NTREIS MLS Provider Association.

I agree that if the Individual named above utilizes the NTREIS MLS in any non-permitted way, I will notify my MLS Provider Association and pay the required fees and/or fines set forth herein.
